February 2009 Structural
Engineer report we had updated with more granular
details. AFTER we removed brick and siding from our
home, we asked John to come out to provide us with
more granular details we thought we would be able to
submit during our trial.

his detailed structural report. NOTE FLASHING
and WEEP HOLES

The inspections on February 11 and
17 2009 were made to review the current condition of your
house.
Pieces of vinyl siding and brick veneer were
removed and confirmed that the windows were not
properly flashed per the manufactures
recommendations.
This report is an addendum to
initial inspection report and findings prepared for
Keystone Engineering and describes in detail the
work necessary to correct the deficiencies generally
described in the initial report finding.
“To correct the water leaks,
flashing and
weep holes must be installed in at the bottom of the
brick veneer in accordance with the Internal
Residential Building Code and the windows and doors
must be properly flashed in accordance with the
manufacturer’s recommendations.”

5 year history with
water infiltration
issues into our
brand new Heartland Homes
home. Water
issues started
3 months after closing
on our brand new
Heartland Homes
house. Heartland
Homes was notified every
single time we had water
infiltration. As you can see
above (review 58 emails
to... tab), we were told they were
working on our issues.
Shortly after our 1
year warranty was over, we
never heard back from our
new home builder, Heartland
Homes.
Even thought we were
told Heartland Homes was
working on our water
infiltration issues, we
never saw any changes in the amount of
water coming into our brand
new Heartland Homes home.
We were never told
about anything they were
working on to correct our
water issues. We were never asked
if there were changes to the
water infiltrating our home.
Nor were we even told
they were done working on
the outside of our home to
correct our water infiltration issues,
nothing. Heartland
Homes just disappeared.
Even after we sent a
certified package that was
signed for to the office of
the owner
of Heartland Homes Alan
Gillespie or Marty
Gillespie, we hear nothing.
See our photos and
you can see there are no
changes to the amount of
water coming into our home.
After we filed a case with
the Better Business
Bureau, shortly
thereafter we hear back from
the builder. During our BBB case filing,
we saw Heartland Homes
attempting to repair our
water infiltration issues. All of the work Heartland
Homes did was at grade level
and below, nothing above
grade for whatever reason. They did seal the lower
brick on our home, that was
it. None of our water issues
resolved by the builder that built our Heartland Homes
home.
They never resolved our
water infiltration issues
during our BBB case, our
next step was the court
system. All details are outlined in
our website, which I am
still working to complete.
We won the verdict from the
Judge in our lawsuit.

We never changed any grading or touched our landscaping due to the issues we've
had..
"One (1) year dry basement guarantee to become null and void."
Our experience has only been Two (2) months of a dry basement. From 2004 til now
(2009) there is nothing we can do with our basement due to the excessive rain water in
our foundation walls.

In our opinion we should see something similar on our home and we don't. We have no weep holes installed and we have no flashing that we can see.

state weep holes installed.

Building Code

building permit
below the construction on our
home started in 2003. We closed on our home February
2004.

"Flashing
shall be installed at the perimeters of exterior door and window assemblies... etc"
