homes and communities. Here are the complete details of our Heartland Homes Pittsburgh's #1
custom home builder experience.
I've updated some of our Court Trial Details
further below & expenses we've
had to pay trying to get the home builder to resolve our
issues.
You'll see
we won the verdict from the Judge.
We decided to
file a discontinue with our case because we will be over
$50,000.00 upside down
(see below)
in our case with the
monies settlement.
The letter was signed for however we never received a
response within the
three week date.
We had no other course but to take action.
We are not difficult people to work with at all.
We work
hard, saved our monies and spent a few years looking for
the right home we wanted to buy.
Please KEEP
IN MIND - Heartland Homes DID specifically state they
were working on our new home issues:
July 22 2004 - "basement
remedy to being in the next few weeks..."
& Sept 21 2004 - "Castleview
is still a work in progress..."
& January 21 2005 (8 months after our water issues started) -
"We will continue to work towards a solution, weather is a factor
now..."
Review emails from Heartland Homes
stating they would continue to work towards a solution.

We are not builders or in home construction.
IN OUR
OPINION: FLASHING and WEEP HOLES are installed in a home
for a reason.
Even the window manufacturer Andersen Windows state
"UNIT must be properly flashed...".
Building Code
2003 state flashing and weep holes are to be installed,
etc.
No structural engineer has ever been to our home on behalf of or
representing Heartland Homes,
at any time. |

The $26,026.83 we
have spent as of May 2009 does not include any repairs we
have yet to do.
I will post that
information as well, our bids
came back $22,000 - $29,000
approximately.
Since we now know FLASHING was
not installed per the
manufacturers instructions + no
weep holes were installed, there
is some major repair work
required. I will post our Structural Engineers detailed
report and structural bids we have.
Please keep in mind: at NO
time
did Heartland Homes ever have a
Structural Engineer or
Structural Inspector come inside our home to look at our issues,
at no time. This fact can not be
disputed!

We always want to make sure
we provide all of the details we have, so you have a
complete picture.
I've updated some of our Court Trial Details, you'll see
we won the verdict from the Judge.
However we decided to
file a discontinue with our case because we will be over

We are just going to pay for all of our repairs
ourselves because we have spent some much of everything
already trying to get the builder to resolve our issues.
We did not initiate any actions until Heartland Homes
walked away from our water issues and never asked if our
issues were resolved.
When we sent the certified letter
to
the Heartland Homes office,
the letter was signed for and we still didn't receive a
response.
We had no other course but to take action.
We are not difficult people to work with at all. We work
hard, saved our monies and spent a few years looking for
the right home we wanted to buy.

IMPORTANT DETAILS:
IN our opinion, if our home was built in 2003 and we
have the building permit posted signed in 2003.
International Building Code from 2003 stating
"...flashing shall be installed at the perimeters of
exterior doors and windows..."
How come in the 5 areas WE REMOVED brick & siding, there
is no flashing? See photos below, links above, etc. We
have tons of photos showing we have
NO FLASHING installed in the areas where we removed
brick or siding. According to our expert structural
engineer, flashing and weep holes are to be installed
which falls inline with the Andersen Windows document &
the IBC 2003 documentation.
IMPORTANT: Heartland Homes never had any
structural engineer visit our home. We would have known
and part of our court transcripts state that.
For now, we've
posted our Court Verdict,
Heartland Homes
appeal, our discontinuance we filed due to the
$26,000.00+ we've already spent (see above)
and the repairs we still have to pay for.
A brand new home leaks for a reason or reasons.
The builder told us they will "continue to
work towards a solution.." as stated above.
NO solution, NO resolution,
NEVER heard from builder after our 1 year
warranty was over until we filed our BBB case,
then trial.
Heartland Homes did NOT have an engineer
come to our home to point certain things out to
us. |
